Furthermore, the annual cost of alcohol-related crashes totals more than $44 billion from things like property damage and hospital bills for injuries ranging from minor to catastrophic.

Drunk Driving Laws in Illinois

The state of Illinois, like most states, has greatly increased their penalties for driving drunk in recent years.

  • First-time DWI offenders will be charged with a Class A misdemeanor, which carries with it a minimum one-year revocation of both their driver's license and vehicle registration. If their blood-alcohol content was above .16, they will also have a mandatory minimum fine of $500 and at least 100 hours' community service. First-time offenders can install and maintain, at their own expense, an ignition interlock device to avoid a driver's license suspension.
  • Those convicted of a second DWI offense will also be charged with a Class A misdemeanor, but face at least five days in jail or 240 hours of community service. Their driving privileges will be revoked for five years, although they can apply for a Restricted Driving Permit (RDP) and install an ignition interlock for five years on all vehicles registered in their name.
  • Beginning with a third DWI offense, Illinois drivers will face felony charges and suspension of their driver's license for at least 10 years, with lifetime revocations beginning at a 4th offense.
  • Illinois also increases DWI punishments if someone is transporting a child under the age of 16, or is in an accident. Felony DUI charges, also known as "aggravated DUI", are also applied to DUI accidents that result in "great bodily harm, permanent disability or disfigurement". For these convictions, a driver's license is revoked for at least two years.
