Motorcycle Accident Lawyers in Illinois

Motorcycle Accident Lawyer Southern Illinois. Motorcycles offer a driving experience that you cannot get with a truck or car. Unfortunately, motorcycles are not nearly as safe as other vehicles and their accidents often result in extensive injuries. According to the National Safety Council, motorcyclists are victims of 14% of all traffic fatalities in the United States despite being just 3% of registered vehicles in the country, and motorcycle rides being just .6% of all vehicle miles traveled in the US. This means that motorcycles are 30 times more likely to be killed, and five times more likely to be injured, in a traffic accident when compared to automobile drivers. In 2019, the Illinois Department of Transportation reported that 138 motorcyclists were killed, and 2,093 injured, as a result of motorcycle crashes. For context, the total number of fatalities on Illinois roads that year was 1,010 people, meaning that more than one in every ten death in an Illinois motor vehicle accident involved a motorcyclist.

We understand how devastating a motorcycle accident can be because we've fought for the rights and recoveries of Illinois residents and are prepared to use our knowledge of Illinois' traffic laws to fight for you and your loved ones and to make sure that those responsible for your motorcycle accident are held to account. Why Are Motorcycle Accidents So Dangerous?

Motorcycles are lightweight, fast-moving vehicles. They don't offer the protections that trucks and cars do, but they aren't meant to because driving a motorcycle is about enjoying it's freedom and connection to the road. Due to the lack of these protective elements motorcycle accidents are far more likely to result in serious injuries or fatalities. Here are a few reasons why motorcycle accidents can be so traumatic:

  • These vehicles are much lighter than trucks or cars.
  • A lack of serious and life-saving protective elements.
  • The lack of safety equipment that can come into action in the event of a scooter or motorcycle accident (Such equipment, for example, includes seat belts and air bags, both of which are standard in passenger vehicles but not part of motorcycle or scooter equipment.)
  • Lack of Helmets. 71% of Motorcycle Accident Fatalities in the State of Illinois happened because of a lack of a helmet.

Since the onus is on the rider of a motorcycle to protect themselves, and they cannot rely on a seatbelt or a strongly-built car chassis to save them in an accident, every part of a motorcyclist's body is made vulnerable to injury in an accident.

What Are Some Common Motorcycle Accident Injuries?

  • Skin abrasions (also known as road rash)
  • Head injuries
  • Traumatic brain injuries/Concussions
  • Broken bones
  • Muscle and nerve damage

Common Causes of Motorcycle Accidents

Motorcycle Accidents happen for a variety of reasons, and often it is due to the negligence of other drivers. Examples of situations that often cause scooter or motorcycle accidents include (but are not limited to):

  • Drivers not paying attention behind the wheel. This can include not just texting while driving but also general unawareness of other people sharing the road. Many motorcyclists can ride alongside vehicles, a practice known as lane-splitting, or cut through multiple groups of vehicles in stopped traffic, which is called filtering. It should be noted that in Illinois, lane-splitting is prohibited.
  • Aggressive driving habits. Many automobile drivers believe the road is theirs and theirs alone. As such, they fail to give ample space to cyclists and motorcyclists, even though both these groups are entitled to use the road as much as car drivers. Emotions can easily boil over in these circumstances and drivers can force bike riders to crash.
  • Not yielding the right of way. Studies have shown that the most dangerous situation for motorcyclists is when cars make left-hand turns. Since motorcycles can accelerate quicker than cars, it is not uncommon for drivers to think it is safe to turn left when in actuality they still need to yield to oncoming traffic.
  • Dangerous roads. Potholes and uneven pavement are much more dangerous to motorcycles than cars since bike tires are much smaller and thinner compared to car tires. A pothole that may just be a nuisance for a motorist may cause a motorcycle to lose control and crash. Local governing bodies--cities, counties, or the state of Illinois, depending on the road--are legally required to provide safe roads for all who use them, including bikers. As such, you could potentially sue the local government for damages if your accident was caused by poor road conditions.
