Here is the conclusion to our three-part blog 4 Ways Your Social Media Activity Could Hurt a Personal Injury Case.

Final Thoughts on Social Media’s Role in a Personal Injury Case

The bottom line is that social media activity can negatively affect a personal injury case in various ways and that plaintiffs should always defer to their attorney.
The bottom line is that social media activity can negatively affect a personal injury case in various ways and that plaintiffs should always defer to their attorney.

While plaintiffs in personal injury cases should avoid admitting blame and talking badly about defendants in their social media activities (as discussed in detail in the first two parts of this blog series), it’s also important that plaintiffs avoid…

4. Violating Non-Disclosure Agreements with Any Posts

In some personal injury cases, plaintiffs will be legally required to abide by non-disclosure agreements, which effectively prohibit these people from discussing any of the details of a case, an accident, settlement negotiations and/or a final agreed-upon offer. If, however, plaintiffs decide to make any statement about the case in their social media activities, they could end up losing all of their rights to the settlement for their injuries and losses.

Here, it’s also important to point out that a plaintiff’s family may also be bound by the terms of non-disclosure agreements. In other words, if a plaintiff’s loved ones who may be privy to the confidential information of the personal injury case and/or the final settlement in the case decide to take to social media to talk about any aspect of the case, the settlement can still be impacted.

The Bottom Line: Loose Lips Can Sink a Personal Injury Case…

The bottom line is that what you do online matters and that defense lawyers and insurers who are looking for any way out of paying you compensation for your injuries can use what you post to your social media accounts as evidence to hurt your personal injury case.

Therefore, if you are about to initiate a case or are currently involved in a personal injury case:

  • Never discuss your case online.
  • Consider not posting to any of your social media accounts while your case as pending, as you never know when your posts could end up having a negative impact on your rights, your personal injury case and your possible entitlements to compensation.
  • Always let your lawyer do the talking for you.
