Picking up from Disputes with Insurance Companies: When to Fight Back (Part 1), the following is some further information regarding how to recognize and fight back against insurance bad faith practices. While Part 1 of this blog concentrated on a discussion about what to do when you think you are being victimized by insurance bad faith, here in Part 2, we will focus on pointing out some of the specific ways in which insurance companies can act in bad faith.

Some specific examples of insurance bad faith practices can include (but are not limited to) insurance companies:

  • Denying viable claims for bogus reasons (like, for example, attempting to claim that damage inflicted in a car accident was pre-existing and, therefore, won’t be covered by the policy)
  • Offering policyholders significantly less than their claim is worth
  • Holding back payment on a claim to try to get policyholders to accept less compensation than they deserve
  • Attempting to claim that a policy is not active after you have already filed a claim against it (In such cases, the insurance company may try to argue that you did not fully disclose the nature or state of affairs regarding the covered entity; however, if the company has already approved the policy, it cannot claim that it’s inactive once a claim is filed against it, as this practice is known as post-claim underwriting and is illegal).
